A $2,838,749.62 Settlement has been reached in a class action lawsuit against MNGI Digestive Health, P.A. (“Defendant”) involving a Data Incident experienced on or around August 20, 2023, that involved an unauthorized third-party accessing Defendant’s network and computer systems and potentially accessing the Private Information of Class Members.

The Private Information involved potentially included full names, dates of birth, passport numbers, drivers’ license or state identification numbers, medical information, health insurance information, payment card information, account numbers, and Social Security numbers. Plaintiffs also alleged negligence, negligence per se, breach of implied contract, unjust enrichment, breach of fiduciary duty, and violations of various Minnesota laws.

The Class includes: all individuals to whom Defendant sent notice of the security breach incident that Defendant experienced on or about August 20, 2023. The Class specifically excludes: (i) all Persons who timely and validly request exclusion from the Class; (ii) the Judge assigned to evaluate the fairness of this Settlement (including any members of the Court’s staff assigned to this case); (iii) Defendant’s officers and directors, and (iv) any other Person found by a court of competent jurisdiction to be guilty under criminal law of initiating, causing, aiding or abetting the criminal activity occurrence of the Data Incident or who pleads nolo contendere to any such charge. If a Settlement Class Member, your rights are affected whether you act or don’t act.

Settlement Class Members may submit a Claim for the following benefits from the Settlement (1) two years of free Medical Monitoring; (2) Ordinary Loss Claims – up to a total of $10,000 per claimant; and (3) a pro rata (a legal term meaning equal share) cash payment.

If you are a Settlement Class Member, you must submit a Claim Form to receive any benefits by September 04, 2025. The easiest way to submit a Claim Form is online here or you can complete and mail the Claim Form to the Settlement Administrator.

The Court in charge of this case must still decide whether to give final approval to the Settlement, including Co-Lead Counsel’s request for an award of attorneys’ fees and expenses. No Settlement benefits will be provided until the Court approves the Settlement and it becomes Final.

Your Legal Rights and Options in This Lawsuit
Submit a Claim Form

You must submit a valid Claim Form to receive Settlement benefits. A Claim Form must be submitted online by September 04, 2025, or, if mailed, postmarked no later than September 04, 2025

Objection

Stay in the Settlement but tell the Court why you do not agree with the Settlement. You will still be bound by the Settlement if the Court approves it. Objections must be postmarked by August 5, 2025. You will still be bound by the Settlement if the Court approves it.

Exclude Yourself

Get no Settlement benefits. Keep your right to file your own lawsuit against the Released Persons about the Released Claims that are released by the Settlement in this lawsuit. Exclusions must be postmarked by August 5, 2025.

Go to a Hearing

You can ask to speak in Court about the fairness of the Settlement, at your own expense. See FAQ 20 for more details. The Final Approval Hearing is scheduled for September 04, 2025.

Do Nothing

If you do nothing, you remain in the Settlement. You give up your rights to sue and you will not get any money.

The Court must decide whether to approve the Settlement, attorneys’ fees, expenses, and Service Awards. No Settlement benefits will be provided unless the Court approves the Settlement.
